Confidentiality Laws for Homeowner Voting

March 31, 2025

Voter anonymity is an important part of ensuring a vote is held fairly. California has strong confidentiality laws for homeowner voting. It requires that ballots remain secret and can only be accessed by an independent inspector of elections unrelated to the HOA.

Voting in California HOA elections can now be held online, thanks to Davis-Stirling Act amendments made in 2024. Platforms like ElectionBuddy offer tools that let organizations hold fair and secure elections electronically while boosting member participation and confidentiality.

Why Is Confidentiality Important?

If a voter's choices were made public, that person could become subject to pressure to change their vote. For a vote to be completely free from outside influence, voters must be able to vote their conscience privately.

This privacy extends beyond other individuals’ knowledge of how a person voted. If an HOA or organization becomes aware of a member who votes against their wishes, that voter could face retaliation or exclusion. These consequences undermine the concept of free and fair elections.

How Is Confidentiality Protected by Law?

Prior to the Davis-Stirling Amendment, California already required HOA ballots be mailed in double envelopes to ensure voter secrecy. This system was effective in maintaining anonymity, but it led to record low participation as the paperwork requirements were onerous.

After the amendment was passed, HOAs were permitted to hold their elections online. A key stipulation was that HOAs were required to hire an independent inspector of elections to hold custody of the ballots until the election was finished.

Having an independent party in control of the ballots means that the organization has no way to see how individuals voted on a particular issue. This goes a long way towards preventing vote tampering in community elections.

The inspector is also responsible for overseeing the accuracy of the vote. They note any discrepancies or inconsistencies and report them to the organization and its members. Finally, the inspectors oversee record-keeping best practices for HOA elections to guarantee compliance with federal and California voting laws.

How Online Voting Helps Maintain Confidentiality

Secure online voting systems like ElectonBuddy use various methods to protect voter confidentiality and prevent vote manipulation. It starts with 256-bit encryption, the same secure system that major financial institutions use. Other methods like two-factor authentication help verify a voter's identity by requiring them to pass two verification points before accessing their ballots.

Once a vote is cast, it is given a unique identifier code that removes the voter's information. Simultaneously, the voter is provided with a verified receipt showing how their ballot was recorded. Combined, these features can help root out discrepancies and irregularities that may indicate vote manipulation.

Lastly, all of the information is transparently auditable by the independent inspector of elections and is visible to the entire organization. By establishing confidence in voter anonymity and confidentiality, democratic decision-making is strengthened and voter participation is expanded.

ElectionBuddy provides all of these tools and more. With our help, voters can easily view candidate profiles, see proposed ballot measures, and vote with confidence. ElectionBuddy also has certified election experts on staff who can act as independent inspectors under California law, making elections more convenient and secure than ever before!
